Article 1 – Definitions

In these terms and conditions, the following definitions apply:

  • Cooling-Off Period: The period during which the consumer may exercise their right of withdrawal.

  • Consumer: A natural person who is not acting in the course of a profession or business and enters into a distance contract with the entrepreneur.

  • Day: Calendar day.

  • Long-Term Transaction: A distance contract relating to a series of products and/or services, the delivery and/or purchase obligation of which is spread over time.

  • Durable Medium: Any tool that allows the consumer or entrepreneur to store information addressed to them personally in a way that allows future consultation and unchanged reproduction of the stored information.

  • Right of Withdrawal: The consumer’s option to cancel the distance contract within the cooling-off period.

  • Entrepreneur: The natural or legal person who offers products and/or services to consumers remotely.

  • Distance Contract: An agreement in which, as part of a system organized by the entrepreneur for the distance sale of products and/or services, exclusive use is made of one or more techniques for remote communication up to the conclusion of the agreement.

  • Means of Remote Communication: A means that can be used to conclude an agreement without the consumer and entrepreneur meeting simultaneously in the same space.

Article 3 – Applicability

  1. These terms and conditions apply to all offers of the entrepreneur and to any distance contract concluded between the entrepreneur and the consumer.

  2. Before the distance contract is concluded, the text of these terms and conditions will be made available to the consumer. If this is not reasonably possible, the entrepreneur will indicate, before the distance contract is concluded, how the terms and conditions can be reviewed and that they will be sent free of charge at the consumer’s request.

  3. If the agreement is concluded electronically, the text of these terms and conditions may be provided electronically, such that the consumer can easily store it on a durable medium. If this is not reasonably possible, the entrepreneur will indicate where the terms can be consulted electronically and that they will be sent free of charge at the consumer’s request.

  4. In the event of conflicting conditions between these general terms and any specific product or service terms, the provisions most favorable to the consumer shall apply.

  5. Situations or ambiguities not covered by these terms and conditions should be interpreted "in the spirit" of these terms.

  6. For UK consumers, these terms comply with the Consumer Contracts (Information, Cancellation, and Additional Charges) Regulations 2013 and other relevant UK laws.


Article 4 – The Offer

  1. The offer contains a clear and detailed description of the products and/or services. Any images used are true representations of the products. Obvious errors or mistakes in the offer are not binding for the entrepreneur.

  2. Prices in the offer include VAT and, if applicable, shipping costs will be clearly specified.

  3. The entrepreneur reserves the right to modify or withdraw an offer at any time.

  4. The entrepreneur shall indicate whether the goods are being shipped from the UK or internationally (as this may affect delivery times and customs duties).

  5. Any additional costs, such as import duties or taxes for goods shipped into the UK, will be the responsibility of the consumer and will be clearly communicated before purchase.

  6. The availability of products and the timeframes for delivery will also be clearly indicated in the offer. Limited availability or delays due to high demand will be communicated promptly.

  7. Promotional offers or discounts will be valid only for the duration specified in the promotional material and will be subject to specific terms.


Article 5 – The Contract

  1. The contract is concluded at the moment of acceptance by the consumer of the offer and compliance with the conditions set therein.

  2. If the consumer accepts the offer electronically, the entrepreneur will confirm receipt of acceptance electronically. Until receipt of this acceptance has been confirmed, the consumer may terminate the agreement.

  3. The entrepreneur shall ensure proper data security during electronic communication and payment.

  4. For contracts with UK consumers, the entrepreneur complies with the Consumer Rights Act 2015 and ensures all key terms are fair, transparent, and clearly communicated.

  5. The consumer has the right to cancel an order before it is dispatched. For products shipped directly from third-party suppliers (dropshipping), cancellations may be subject to additional processing times or fees.

  6. The entrepreneur reserves the right to reject an order if there are reasonable grounds to believe that the consumer will not comply with the contract, such as suspected fraud or insufficient payment information.


Article 6 – Right of Withdrawal

  1. Consumers may withdraw from a purchase within 14 days without giving any reason. The withdrawal period starts the day after the consumer or a third party designated by the consumer (not the carrier) receives the product.

  2. During the cooling-off period, consumers must handle the product and packaging with care. They should only use the product to the extent necessary to assess it.

  3. If a consumer wishes to withdraw, they must notify the entrepreneur via email or another durable medium within the cooling-off period.

  4. The consumer is responsible for the cost of returning the product unless otherwise stated in the offer. Products must be returned within 14 days of notifying the entrepreneur of the withdrawal.

  5. Refunds will be processed within 14 days after the entrepreneur has received the returned goods or proof of return.

  6. Exclusions from the right of withdrawal apply to:

    • Custom-made or personalized goods.

    • Goods that deteriorate quickly or have a limited shelf life.

    • Sealed goods that are not suitable for return due to health or hygiene reasons once unsealed.

  7. If a product is damaged during return shipping due to improper packaging by the consumer, the entrepreneur reserves the right to deduct the depreciation in value from the refund.


Article 7 – Delivery

  1. Products are shipped to the address provided by the consumer.

  2. Delivery times are indicative. Delays do not entitle the consumer to compensation or cancellation unless explicitly agreed.

  3. For UK deliveries, the entrepreneur ensures compliance with the Consumer Contracts Regulations 2013 regarding delivery times. Goods must be delivered within 30 days unless otherwise agreed.

  4. Products may be shipped directly from third-party suppliers as part of the dropshipping model. Consumers will be informed if this applies.

  5. Import duties, VAT, or other taxes for shipments entering the UK are the responsibility of the consumer unless otherwise stated.

  6. The risk of loss or damage to the goods transfers to the consumer once the goods are delivered to the consumer.

  7. If a product cannot be delivered due to incorrect address details provided by the consumer, additional shipping costs may be charged to the consumer for re-delivery.

  8. In the event of unforeseen delays due to circumstances beyond the entrepreneur’s control, such as customs inspections or logistical issues, the consumer will be informed promptly.


Article 8 – Liability

  1. The entrepreneur’s liability is limited to the value of the order, unless otherwise required by UK law.

  2. The entrepreneur is not responsible for delays, damages, or losses caused by third-party suppliers or shipping companies.

  3. The entrepreneur is not liable for any customs fees, import duties, or additional charges incurred for international shipments.

  4. Consumers are advised to inspect products upon receipt and report any damages or issues immediately.

  5. The entrepreneur is not responsible for the consequences of incorrect use or mishandling of products by the consumer that result in damage or injury.

  6. In the event of force majeure, the entrepreneur is not liable for delays or non-performance. Force majeure includes but is not limited to natural disasters, acts of war, labor disputes, and interruptions to transportation or communication networks.


Article 9 – Complaints

  1. Complaints must be submitted via email within 7 days after the issue arises.

  2. The entrepreneur will respond to complaints within 14 days.

  3. If a complaint cannot be resolved amicably, the consumer may refer the matter to an Alternative Dispute Resolution (ADR) body in accordance with the UK Alternative Dispute Resolution for Consumer Disputes (Competent Authorities and Information) Regulations 2015.

  4. For online transactions, consumers may also use the Online Dispute Resolution (ODR) platform provided by the European Commission.

  5. Complaints must be accompanied by relevant documentation or photographs if the issue concerns product quality or damage.

  6. If a complaint is found to be valid, the entrepreneur may offer a replacement, repair, or partial/full refund depending on the circumstances.


Article 10 – Governing Law

  1. These terms and conditions are governed by Dutch law.

  2. However, UK consumers are entitled to rely on mandatory consumer protection provisions under UK law, including the Consumer Rights Act 2015 and related regulations.

  3. Disputes shall be submitted to the competent court in the Netherlands unless UK consumers are entitled to bring proceedings in the UK under applicable consumer protection laws.


Article 11 – Pricing and Payment

  1. All prices displayed on the website are inclusive of VAT unless explicitly stated otherwise.

  2. The consumer is responsible for any additional costs, such as currency conversion fees or bank charges, that may apply to international transactions.

  3. Payment methods accepted include credit cards, debit cards, and other electronic payment systems as specified on the website.

  4. Full payment must be made at the time of purchase unless otherwise agreed.

  5. In the event of non-payment, the entrepreneur reserves the right to cancel the order or suspend delivery.

  6. If a pricing error occurs, the entrepreneur is not obligated to fulfill the order but will inform the consumer promptly and offer a refund or an alternative solution.


Article 12 – Subscriptions and Automatic Renewals

  1. For products or services offered on a subscription basis, the terms of the subscription, including duration and renewal policies, will be clearly communicated before the agreement is finalized.

  2. Consumers may cancel subscriptions by notifying the entrepreneur at least 14 days before the renewal date.

  3. Refunds for subscription cancellations will be processed in accordance with the terms specified at the time of purchase.


Article 13 – Force Majeure

  1. The entrepreneur is not liable for failure to perform any obligations due to circumstances beyond their reasonable control, including but not limited to natural disasters, acts of government, labor disputes, and supply chain disruptions.

  2. If a force majeure event occurs, the entrepreneur will notify the consumer as soon as possible and may suspend performance of the contract or offer a refund.


Article 14 – Privacy and Data Protection

  1. The entrepreneur collects and processes personal data in accordance with applicable data protection laws, including the UK General Data Protection Regulation (UK GDPR).

  2. Personal data will only be used for the purposes outlined in the entrepreneur’s privacy policy, which is available on the website.

  3. Consumers have the right to access, correct, and request deletion of their personal data by contacting the entrepreneur.

  4. The entrepreneur ensures that personal data will not be shared with third parties without the consumer’s consent, except where required by law.
